Law and freedom. On a fundamental relationship in human coexistence
One can only speak meaningfully of humanity if one has learnt to speak of its “talent” for inhumanity. The law is an ingenious invention that has not taken mistrust in naïve humanity and immediate disappointment in neighbouring people as an opportunity to attack one another, but has formulated the conditions under which it is possible to get along with one another. However, the state is not called a constitutional state because it can call for order with the help of the law, but because it protects the citizen from the enforced sovereignty of the community in individual cases. Liberal forms of socialisation are formed at the moment when individuals and institutions recognise that they cannot act peacefully as the final authority. It is not good for freedom if it is idealised. Conversely, the law expresses its respect for individual life by presupposing and protecting its freedom. But how can we think about this?
